5) We have no reason to believe that errors exist in the data or services furnished. If there are any such errors the parties hereto have no liability for any consequential, incidental or punitive damages. No warranty, either expressed or implied, including but not limited to those of merchantability or fitness for a specific purpose is made. Any liability is limited to amount paid by you to SC "MEDING COMIMPEX"SRL.

InterMeding SHALL NOT BE LIABLE TO YOU FOR ANY LOSS OR INJURY ARISING OUT OF OR CAUSED, IN WHOLE OR IN PART, BY InterMeding NEGLIGENT ACTS OR OMISSIONS IN PREPARING OR DELIVERING THE PRODUCTS OR IN DOING ANYTHING RELATED THERETO. InterMeding WILL NOT BE LIABLE FOR CONSEQUENTIAL DAMAGES, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
This Agreement and performance hereunder shall be governed by and construed in accordance with the laws of the Romania and any action, suit or proceeding instituted hereunder or related hereto shall be maintained in the courts of Romania , which courts shall have exclusive jurisdiction for such purposes.
